Consequential losses

When a consumer suffers loss as a direct consequence of a faulty product or installation, the consumer may be able to claim damages.

However the consumer must in all circumstances attempt to reduce the loss. So if they notice that their newly installed washing machine is leaking, they should report the matter to the retailer immediately not wait until severe damage has occurred.

The consumer might find that they incur extra expense as a direct result of buying faulty goods such as spoilt food from a faulty freezer, although this may be covered by household insurance.

Claims for consequential loss normally only cover the actual loss incurred. 

Claims for distress, inconvenience or disappointment are not normally covered and it would be up to the courts to decide.
